Beyond Restaurant Group, LLC D/B/A Pokeworks (“Pokeworks”) values your privacy and aims to provide transparency around how we collect, use, and disclose your information.

This privacy policy describes our practices in connection with information that we collect through websites operated by us from which you may be accessing this privacy policy (the “Websites”), through the software applications made available by us for use on or through computers and mobile devices (the “Apps”), through our social media pages that we control from which you may be accessing this privacy policy (collectively, our “Social Media Pages”), as well as through text or SMS messaging that you may have signed up for and html-formatted email messages that we send to you (collectively, including the Websites, the Apps and our Social Media Pages, the “Services”).

Please read this privacy policy carefully. By using the Services, you consent to our collection and use of your Personal Information (described below) as described in this privacy policy. Except as set forth in this privacy policy, your Personal Information will not be used for any other purpose without your consent. You may withdraw your consent to our processing of your personal information at any time. Withdrawing consent may result in your inability to continue using the Services or some of their features.

THIRD-PARTY SERVICES AND ORDERING PLATFORMS

Pokeworks partners with Olo, Inc., (“Olo”), a third-party technology provider, to support and operate certain online ordering functions, including catering orders and other web-based ordering experiences. Olo facilitates the technical processing of orders placed through our digital platforms, including collecting order details, processing payments, and coordinating delivery or pickup logistics.

When you place an order through these Olo-powered platforms, the information you provide-such as your name, contact details, order information, and payment data-is collected directly by Olo. This information is governed by Olo’s own privacy policy, not this Pokeworks Privacy Policy. We also use certain services provided by Thanx, Inc. (“Thanx”) to help facilitate customer loyalty and reward programs, special offers, and related digital services. As part of these services, some of your Personal Information may be shared with Thanx (including, without limitation, your name, email address, payment information, and purchase history). Thanx processes this information solely on behalf of Pokeworks and in accordance with this privacy policy. Thanx is considered a service provider under applicable privacy laws and is contractually prohibited from using this data for any purpose other than delivering services to Pokeworks.

Thanx may also rely on other third-party service providers, including Basis Theory, which securely processes payment data and others that help it operate its digital services, such as hosting, information technology, support, email and text message delivery, and website analytics services. 

When you interact with third-party service providers we use (including payment processors and digital platforms to support the Services such as order processing, payments, and customer loyalty programs), your Personal Information may be shared with these providers as necessary to fulfill your requests. These providers are contractually required to process Personal Information solely on behalf of Pokeworks and in accordance with this privacy policy. They are not permitted to use or disclose your information for any other purpose.

PERSONAL INFORMATION WE MAY COLLECT

“Personal Information” refers to information that identifies, relates to, describes, or could reasonably be linked, directly or indirectly, to an individual or household. Depending on how you interact with us, we may collect the following categories of Personal Information through our websites, mobile apps, ordering platforms (including third-party systems operated on our behalf), rewards programs, marketing channels, and customer support systems:

  • Identifiers such as your full name, email address, phone number, postal address (billing and shipping), date of birth, gender and other information you include in your account profile.
  • Account and loyalty program details, including account login credentials, enrollment status, points or rewards balance, redemption activity, and order preferences.
  • Transactional information, such as your order history, purchase amounts, items ordered, and payment method.
  • Payment data, such as your payment card number and other billing information, is handled by Olo and Basis Theory.   • Image data, such as pictures of order receipts you place with Merchant to receive loyalty credit.
  • Communications, such as information about you that you provide when you correspond with Pokeworks.
  • Device and internet activity, including IP address, device ID, browser type, operating system, and interactions with our websites or apps (e.g., pages viewed, time spent).
  • Geolocation data, such as approximate location derived from your device, if you opt in.
  • Marketing and communication preferences, including your opt-in status for SMS or email, and interactions with our campaigns (e.g., whether you opened a message or clicked a link), your preferences for receiving our communications and any other preferences you set in your account.
  • Inferences, drawn from your transaction and interaction data to help personalize your experience or our offers.
  • Other information you provide voluntarily, such as through surveys, customer feedback, reservation notes, social media interactions, or support requests.

Sharing with card networks.

If you connect a payment card to the Services or Thanx platform, your payment card information will be shared with your payment network (e.g., AMEX, MasterCard or Visa) to enable the payment network to examine transactions on your connected payment card and to facilitate your participation in the Services (e.g., to administer the loyalty programs you join and your accrual of rewards). You can remove your payment card from your account at any time in your settings. When you do so, no future transactions will be associated with the removed card, but your previous transactions will remain associated with your account and may still be used for reporting, rewards history, or compliance purposes.

YOUR CHOICES

When using the customer loyalty and reward programs, you may have the choices below regarding the collection, use and sharing of your Personal Information:

  • Opt-out of offers and promotional communications: You can opt out of promotional emails and text messages sent via the Thanx platform by following the instructions provided in the communication you receive. Please note that if you opt out, you may still receive certain transactional communications regarding the Services, such as updates to the terms applicable to the Services or this Privacy Policy.
  • Changing or deleting your account information: In addition to your ability to exercise consumer rights as set forth in the Supplemental CCPA and U.S. Privacy Laws Notices – Notice at Collection, you can review, update, correct or delete the personal information accessible from your accounts by contacting [email protected]. If you request to delete all your information or any information necessary to maintain your account, then your account may become deactivated.

AUTOMATICALLY COLLECTED PERSONAL INFORMATION

When you use the Services, Thanx and other service providers and advertising partners may automatically log information about you, your computer or mobile device, your activity over time, and your interactions with marketing communications, such as:

  • Device data, such as your device’s operating system type and version, manufacturer and model, browser type, mobile application/SDK version, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), internet protocol (IP) address, unique identifiers (including identifiers used for advertising purposes), API keys, language settings, mobile device carrier, radio/ network information (e.g., WiFi, LTE, 3G) and status, time zones, and general location information such as city, state or geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to our platform, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.
  • Precise geolocation when authorized by you.

If you submit any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this privacy policy.

HOW WE MAY COLLECT PERSONAL INFORMATION

We and our service providers may collect Personal Information in a variety of ways, including:

Through the Services: We may collect Personal Information when you sign up for emails, create a rewards account, or place an order. 

Offline: We may collect Personal Information from you when you visit our restaurants, provide feedback, or contact us. 

From other sources: We may receive Personal Information from public databases, joint marketing partners, social media platforms, and other third parties.

HOW WE MAY USE PERSONAL INFORMATION

We may use your Personal Information for a variety of business and operational purposes, including:

  • To respond to your inquiries and fulfill your requests, such as to send you newsletters, respond to feedback, or deliver requested materials.
  • To send you information, such as changes to our terms, conditions, and policies, or service-related updates (e.g., delivery status or account notifications).
  • To send you information relating to the status of your order or delivery.
  • To complete and fulfill transactions or services, including order processing, payment confirmation, delivery coordination, and related customer service communications.
  • To provide marketing communications we believe may be of interest to you, such as promotions, new product announcements, and personalized offers. This may include the use of cookies or similar technologies to tailor content based on your browsing or purchase history.
  • To operate loyalty and rewards programs, including tracking your points, redemptions, and preferences.
  • To allow participation in sweepstakes, contests, surveys, and other promotions, and to administer and notify you about these programs.
  • To improve and personalize your experience, such as remembering your preferences, enhancing navigation, and recommending products or services that align with your interests.
  • For internal business purposes, such as data analysis, audits, fraud detection and prevention, security monitoring, new product development, service improvement, trend analysis, campaign effectiveness, and operational efficiency.
  • To comply with legal and regulatory obligations.

We may also aggregate or anonymize data for analytics or business intelligence purposes. Aggregated data is not considered Personal Information under this policy and may be used for any lawful purpose.

SMS COMMUNICATIONS

By opting in to receive SMS communications from Pokeworks, you consent to receive recurring text messages related to promotions, updates, offers, order confirmations, and other information connected to your interactions with Pokeworks. Message frequency may vary. Message and data rates may apply depending on your mobile carrier plan.

You may opt out of SMS messages at any time by replying STOP. After sending STOP, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again. For assistance, reply HELP or contact us at [email protected].

Your mobile number and SMS preferences are maintained in accordance with this privacy policy. We do not sell or share your SMS-related information, including phone numbers, with third parties for their marketing purposes. SMS data may be processed by third-party service providers strictly on our behalf to deliver messages and administer the program, and they are contractually required to use this data only for that purpose.

Participation in our SMS program is not a condition of any purchase. Supported carriers are not liable for delayed or undelivered messages. You must be at least 13 years old to use this service.

ADDITIONAL INFORMATION

Retention: We retain Personal Information only as long as necessary to fulfill the purposes described in this privacy policy unless a longer period is required by law.

Cookies and Tracking: We and our service providers use cookies and similar technologies to operate our services, analyze trends, personalize content, and serve targeted advertisements. You may manage cookie preferences through your browser settings.

Children’s Privacy: Our services are not directed to children under 13. We do not knowingly collect Personal Information from anyone under 13.
